TERMS & CONDITIONS

The Mote Poh Terms & Conditions is a legally binding agreement between Mote Poh Co., Ltd. “Mote Poh”, the Client, and the Client's Employees.
The Client agrees to be bound by these Terms & Conditions by completing the Order Form.
The Employee agrees to be bound by these Terms & Conditions by using the Mote Poh mobile application.
Mote Poh may modify these Terms & Conditions from time to time. All changes to these Terms & Conditions will be posted on the Mote Poh website. The Terms & Conditions will always indicate the date it was last revised. When the Client and/or the Employee uses the Mote Poh service after those changes are posted, they are deemed to have accepted the new Terms & Conditions and agree to be bound by any changes to the Terms & Conditions.
1.1 The Client has subscribed to one or more Mote Poh Employee Benefits Programs, as selected in the Order Form.
1.2 The Client's Subscription will start on the date specified and continue until modified or terminated in accordance with Section 8.
2.1 If the Client enrols an Employee in the Discounts Program, the Employee may redeem discounts and special offers at participating merchants, as updated from time to time.
2.2 The Employee may redeem a benefit via the Mote Poh mobile application by following the standard redemption procedures, before the expiration date, in compliance with any stated terms and conditions.
2.3 The Employee may not sell or exchange discounts.
3. SALARY ADVANCE
3.1 If the Client enrols an Employee in the Salary Advance program, the Employee may request Salary Advances.
3.2 The Employee may request a Salary Advance via the Mote Poh mobile application.
3.2 The Client may approve or reject the Employee's Salary Advance request.
3.3 If the Client approves the Employee's Salary Advance request, Mote Poh will use best efforts to disburse an approved Salary Advance to the Employee within 1 business day.
3.4 For each Salary Advance that Mote Poh successfully disburses:
3.4.1 Mote Poh will charge the Employee a Service Fee, as specified in the Mote Poh mobile application;
3.4.2 Mote Poh will also charge the employee a Transaction Fee, as determined by the Mobile Wallet or Bank selected by the Employee;
3.4.3 The Client will deduct the Salary Advance, Service Fee, and Transaction Fee from the Employee's next salary disbursement;
3.4.4 The Client will pay Mote Poh for all Salary Advances, Service Fees, and Transaction Fees within 7 days of receiving Mote Poh's monthly invoice. If the Client does not pay Mote Poh in full within 7 days, the Client will pay a late fee of 3% per month or part thereof.
4.1 The Employee may enjoy unlimited consultations with General Practitioner Doctors via the MyanCare Telemedicine mobile application and/or call center.
4.2 The Employee may redeem consultations via the Mote Poh mobile application by following the standard redemption procedures, before the expiration date, in compliance with any stated terms and conditions.
4.3 Employees may not sell or exchange consultations.
5. MEDICAL COVER
5.1 The Employee may enjoy unlimited consultations with General Practitioner Doctors and may redeem discounts at easy health clinics.
5.2 The Employee may redeem consultations and discounts via the Mote Poh mobile application by following the standard redemption procedures, before the expiration date, in compliance with any stated terms and conditions.
5.3 Employees may not sell or exchange consultations or discounts.
6. SUPPORT SERVICES
6.1 Mote Poh will operate a Helpline (messenger.com/t/motepoh, +95 9 456 334 541 and firstname.lastname@example.org) to assist Clients and Employees with questions or issues.
7. Price & Payment Schedule
7.1 The Client will pay Mote Poh the price selected in the Order Form.
7.2 The Client will pay Mote Poh the full amount for each period before the start of the period.
7.3 If the Client increases the number of employees enrolled in one or more programs, the Client will immediately pay a prorated amount for the current period.
7.4. Mote Poh will not provide any refund in the event the Client modifies or terminates this Agreement in accordance with Section 8.
8. Modification or Termination
8.1 This Agreement will remain in force until terminated.
8.2 The Subscription, as stated in the Order Form or modified in accordance with Section 8.3, will automatically renew for an additional subscription period on the same terms 1 month prior to the end of each period.
8.3 The Client may modify the Subscription by notifying Mote Poh at least 1 month prior to the start of the next period. Modifications will only apply to subsequent periods.
8.4 Either party may terminate this Agreement for any reason by notifying the other party at least 1 month prior to the start of the next period. If notice is given more than 1 month prior to the start of the next period, then termination will take effect at the end of the current period. However, if termination is given 1 month or fewer prior to the start of the next period, then termination will take effect at the end of the next period.
8.5 Notification must be done in the Client Portal or by writing to email@example.com.
9. Employee Data
9.1 The Client will provide Mote Poh with Employee Data, as required to enrol the Employee in one or more programs.
9.2 Mote Poh will use Employee Data (including employee name, mobile number, email address, photo, Myanmar National Identification Number, LinkedIn name, Facebook name, mobile wallet ID, bank account information, employment status, employment history) to provide the the Employee with Employee Benefits Programs and Support Services.
9.3 Mote Poh will not sell, trade or otherwise divulge Employee Data.
10. Confidentiality & Non-Disclosure
10.1 Mote Poh and the Client guarantee to each other that neither they nor any of their employees, associates or contractors will disclose to any third party any information about the other party which may be reasonably construed as confidential or proprietary, or as set out in Sections 10.2-4. This Section will continue in force at all times during the execution of and after termination of this agreement.
10.2 Proprietary includes but is not limited to any physical and intellectual property of either organization.
10.3 Confidential Information means any information in any form emanating, directly or indirectly, from either party and designated as being confidential or which, under the circumstances surrounding disclosure, ought to be treated as confidential, including without limitation, information relating to: business plans, procedures or processes; descriptions of any product or service; marketing or promotion of any product or service; contractual offers; contracts signed; and information received from others parties that either party is obligated to treat as confidential.
11. Choice of Law and Forum
11.1 Any disputes arising out of or relating to this Agreement shall be determined according to the laws of the Republic of Singapore and shall be heard by a court of competent jurisdiction of the Republic of Singapore.
Mote Poh cares about your privacy and we will use due care to protect your personal information against unauthorised access and miss use.
“Personal Information” means any information which can identify you.
Mote Poh may collect your personal information directly or indirectly - when you interact with Mote Poh or from other sources.
Mote Poh may request your personal information during your course of dealings with Mote Poh and you have the right not to provide your personal information that Mote Poh requests. If it is so, Mote Poh may not be able to provide you the Platform and/or services or may not able to respond to your queries to the Mote Poh.
Mote Poh may also collect your personal information from a variety of sources when you are communicating or interacting with Mote Poh including online or offline, e.g. if you are accessing our social media pages, attending any meetings organised or sponsored by Mote Poh.
Using Your Information
Mote Poh may only use your personal information as follows:
a. to support your experiences to use the Platform;
b. to send you marketing and promotional information and materials.
c. to conducting Market Research;
d. to comply with the Laws and Regulations; or
e. to detect, investigate and prevent any kinds of fraudulent activity;
If there is any other things else we want to your personal information, we will seek your consent separately.
Managing Your Information
Mote Poh will exercise due care to ensure your personal information is stored securely to protect your personal from disclosure or misuse or unauthorised access.
Mote Poh cannot and does not accept responsibility for any unauthorised access, unlawful interceptions or loss of personal information.
Mote Poh may keep your personal information as long as we need.
